Terms of Service

These Terms of Service ("Terms") govern your use of the atom. mobile application and website located at https://useatom.app (collectively, the "Services"), operated by MyAtom LLC, doing business as atom. ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account or using atom., you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

atom. is a personal life dashboard application that helps users track their physical health, mental health, personal growth, and finances. Features include daily check-ins, habit tracking, goal setting, journaling, meditation, breathing exercises, workout logging, sleep tracking, and AI-powered financial insights. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

3. User Accounts

You must create an account to use atom. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary. We reserve the right to terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. In-App Purchases and Subscriptions

atom. offers both free and paid features. Paid offerings include:

  • atom. Pro — a monthly subscription at $4.99/month that unlocks premium features including unlimited AI financial insights, monthly recaps, and advanced analytics.
  • Atom Points — virtual currency that can be purchased and used in the in-app shop to unlock themes, badges, streak shields, XP boosts, and other digital items.

All purchases are processed through Apple App Store or Google Play Store and are subject to their respective terms. We accept Visa, Mastercard, American Express, and Discover through Apple Pay and Google Pay. All payments are in US dollars.

5. Free Trial

We may offer a 7-day free trial for atom. Pro. At the end of the free trial period, your account will not be charged automatically. Your subscription will be suspended until you choose to upgrade to a paid plan. We reserve the right to modify or discontinue free trial offers at any time.

6. Refund Policy

All purchases of digital goods including Atom Points and in-app shop items are final and non-refundable. Subscription refunds are handled in accordance with Apple App Store and Google Play Store policies. We do not offer refunds outside of what is required by applicable law or platform policy.

7. Cancellation

You may cancel your atom. Pro subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to Pro features until the end of the paid period.

8. User Generated Content

atom. allows you to create and store personal content including journal entries, habit names, goals, and profile information ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to store and display your content solely for the purpose of providing the Services to you. You are solely responsible for your User Content and agree not to post content that is unlawful, harmful, or violates the rights of others.

9. Prohibited Activities

You agree not to:

  • Sell, transfer, or share your account with others
  • Attempt to reverse engineer, scrape, or copy any part of the Services
  • Use the Services for any unlawful purpose
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to advertise or offer to sell goods and services

10. Health and Financial Data Disclaimer

atom. is not a medical provider, financial advisor, or licensed professional service. The information provided through the Services, including health tracking data and AI-powered financial insights, is for informational and personal tracking purposes only and should not be considered medical advice, financial advice, or a substitute for professional consultation. Always consult a qualified professional before making health or financial decisions. We make no warranties regarding the accuracy or completeness of any data displayed in the Services.

11. Third-Party Services

atom. integrates with third-party services including Plaid (bank connections), Apple HealthKit, Google Fit, and OpenAI (AI insights). Your use of these integrations is subject to the respective terms and privacy policies of those providers. We are not responsible for the availability, accuracy, or practices of any third-party services. atom. may also link to third-party websites including affiliate partners. We are not responsible for the content or practices of any linked websites.

12. Intellectual Property

All content, features, and functionality of atom. including but not limited to the name, logo, design, text, graphics, and software are owned by MyAtom LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Services without our express written permission.

13. Limitation of Liability

To the fullest extent permitted by law, MyAtom LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall first be attempted to be resolved through informal negotiations. You agree to contact us at hello@useatom.app and give us 30 days to resolve the dispute before initiating any formal proceedings. If informal negotiations fail, the dispute shall be resolved through binding arbitration in Illinois, United States, in accordance with the rules of the American Arbitration Association. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action. If a dispute proceeds in court rather than arbitration, it shall be brought exclusively in the courts of Illinois. Any claims must be brought within 1 year of the event giving rise to the claim.

15. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Services at any time without notice or liability.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by sending an email to the address associated with your account. Your continued use of the Services after such notification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.
